Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of GrowFlux's websites, applications, APIs, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for an organization, you represent that you have authority to bind that organization.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate information, protect your login credentials, and promptly notify us of unauthorized access. You are responsible for activity under your account and for managing users and permissions in your organization.

3. Subscriptions, trials, and credits

Paid plans, usage credits, trial terms, renewal dates, and prices are shown before purchase. Unless stated otherwise, subscriptions renew automatically until canceled. You authorize the applicable payment provider to charge the payment method on file. You may cancel before renewal; access continues through the paid period unless otherwise stated.

Credits and usage limits are service units, not money or stored value. They are non-transferable and may expire as described in your plan. Taxes, exchange fees, and provider charges may apply. Refunds are provided where required by law or expressly stated in the applicable offer.

4. Your content and instructions

You retain ownership of content, data, prompts, brand materials, and other information you provide ("Customer Content"). You grant GrowFlux a limited license to host, process, transform, display, and transmit Customer Content only as needed to provide, secure, and improve the Services and follow your instructions.

You represent that you have the rights and permissions needed for Customer Content and publishing destinations. You are responsible for reviewing factual claims, intellectual property rights, regulatory requirements, and the suitability of content before approval or publication.

5. Connected accounts and publishing

You may connect third-party accounts through authorized methods such as OAuth. You direct GrowFlux to access those accounts only to provide the features you choose. You remain responsible for complying with each provider's terms and for keeping connected accounts in good standing.

GrowFlux will not request a social network password or session cookie. You must review and approve the content, destination, and publishing action for each scheduled or immediate publication. Do not use the Services for spam, artificial engagement, unauthorized automation, scraping, or actions that users do not understand or intend. You may disconnect a provider at any time.

6. AI-generated output

The Services may use artificial intelligence to suggest workflows and generate content. Output may be inaccurate, incomplete, or similar to content produced for others. You must review output before use and must not rely on it as legal, medical, financial, or other professional advice. GrowFlux does not guarantee that output is unique, error-free, or suitable for a particular purpose.

7. Acceptable use

You may not use the Services to violate law or third-party rights; distribute malware or deceptive content; impersonate others; send spam; manipulate platform engagement; bypass access controls or rate limits; probe or disrupt the Services; scrape third-party services; expose credentials; or use the Services to build a competing model or service through unauthorized extraction.

8. GrowFlux technology

GrowFlux and its licensors retain all rights in the Services, software, designs, documentation, and trademarks, excluding Customer Content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. Feedback may be used without restriction or obligation.

9. Third-party services

The Services may depend on social networks, AI providers, payment processors, hosting providers, and other third parties. Their services are governed by their own terms. GrowFlux is not responsible for third-party outages, policy changes, content removal, account restrictions, or discontinued APIs. We may modify or discontinue an integration when necessary for security, compliance, or provider requirements.

10. Suspension and termination

You may stop using the Services or cancel your subscription at any time. We may suspend or terminate access for nonpayment, security risk, unlawful activity, material breach, provider requirements, or conduct that harms the Services or others. Where reasonable, we will provide notice and an opportunity to cure. Sections that by their nature should survive termination will remain in effect.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." GrowFlux disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, particular marketing results, continued availability of a third-party integration, or that all errors will be corrected.

12. Limitation of liability

To the maximum extent permitted by law, GrowFlux will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. GrowFlux's total liability arising from the Services will not exceed the amount you paid to GrowFlux for the Services during the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

13. Governing law and changes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. Courts located in Hong Kong will have exclusive jurisdiction, except where applicable consumer law requires otherwise.

We may update these Terms as the Services or legal requirements change. We will post the revised Terms and update the effective date. Material changes may be communicated through the Services or email.
